MOD LUXE Limited Warranty

This Limited Warranty outlines the warranty coverage provided by MOD LUXE Pty Ltd ("MOD LUXE," "we," or "us") for any defects in material or workmanship in new MOD LUXE products purchased directly from www.mod.luxe (the "Site"). This Limited Warranty does not cover all issues, so please review the details carefully to understand what is included and excluded.

1. Who is Covered

This Limited Warranty is extended exclusively to the original consumer purchaser (referred to as "you" or "your") and cannot be transferred or assigned. If you purchased a MOD LUXE product through our Site, you may obtain coverage under this warranty. This warranty does not apply to MOD LUXE products purchased from unauthorised sellers or third-party vendors.

2. Warranty Period

The Limited Warranty coverage period is one (1) year from the date of purchase, as documented in your proof of purchase. If a replacement or repair is made under this Limited Warranty, the warranty period remains the same from the original date of purchase, or ninety (90) days from the date of replacement or repair, whichever is longer.

3. What is Covered

MOD LUXE stands behind the quality of its products and will cover defects in materials or workmanship under this Limited Warranty. This warranty applies only to products used for personal, non-commercial purposes, and is subject to the conditions outlined below.

4. What is Not Covered

This Limited Warranty does not cover any damage or defect caused by:

  • Commercial use;
  • Normal wear and tear;
  • Misuse, neglect, or abuse;
  • Accidents, including but not limited to collision, fire, or exposure to liquids;
  • Alteration, unusual stress, modification, improper or unauthorised repair, or improper storage.

In addition, any product returned with removed, damaged, or tampered labels, or other alterations will void this warranty. Consequential, indirect, and incidental damages are not recoverable under this Limited Warranty, subject to applicable law.

5. What MOD LUXE Will Do

If MOD LUXE authorises a return of your product under this Limited Warranty, we will determine, at our discretion, whether to repair or replace the defective product. Replacement may involve a new or remanufactured product. If we conclude that repair or replacement is not viable, we may, at our discretion, issue a refund for the purchase price you paid for the product.

All repair or replacement work under this warranty will be performed by MOD LUXE or an authorised representative. Repaired or replaced products are covered for the remainder of the original warranty period or ninety (90) days, whichever is greater.

6. Non-Warranty Repairs

If your MOD LUXE product does not qualify for warranty service under this Limited Warranty, or if you are unable to provide proof of purchase, you may request a non-warranty repair service from MOD LUXE. Charges may apply for any repairs performed outside of the warranty. Please contact us at support@mod.luxe for more information.

7. Warranty Claims Process

To make a claim under this Limited Warranty, please contact our Customer Service team at support@mod.luxe with your proof of purchase and details of the defect. After we review your claim, we may authorise a return for inspection. Please follow any instructions provided by Customer Service for the return process. You are responsible for transport or delivery costs associated with a warranty claim, except in cases where MOD LUXE determines the defect is covered by the warranty.

8. Governing Law

This Limited Warranty shall be governed by the laws of New South Wales, Australia, without regard to conflict of law principles. By purchasing from MOD LUXE, you agree that any dispute arising from this Limited Warranty will be resolved in the courts of New South Wales.

This warranty provides specific legal rights, which may be supplemented by rights available under Australian consumer laws. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so certain limitations or exclusions in this Limited Warranty may not apply to you.

9. Additional Rights

This Limited Warranty does not exclude or limit any statutory rights you may have under the Australian Consumer Law or any other applicable consumer protection law in your jurisdiction. If a statutory warranty applies, it operates alongside this Limited Warranty.
