Terms of purchase
1. Purchase and Contract
The purchase of MOD LUXE luxury items and accessories ("Products") through the www.mod.luxe website ("Site") constitutes a contract of sale ("Contract") between MOD LUXE Pty Ltd. ("MOD LUXE" or "we") and you ("Customer").
The Contract is formed upon completion of an order and successful payment, as outlined in Section 6.
2. Product Authenticity and Description
MOD LUXE guarantees the authenticity of its luxury items and accessories. Product descriptions and images on the Site are provided for informational purposes and may vary slightly from the actual product. By purchasing, you acknowledge that minor variations may occur, and MOD LUXE cannot be held responsible for such differences.
Variances may include colour differences due to screen calibrations, slight variations in finish or texture from the manufacturing process, and unique characteristics of natural materials such as wood or metal.
3. Warranty
MOD LUXE stands behind the quality of its products by offering a one-year limited warranty from the date of purchase, covering defects in materials or workmanship. This warranty applies to all MOD LUXE products purchased directly from www.mod.luxe.
Please note that this warranty does not cover normal wear and tear. Additionally, it excludes damages caused by scratches, dents, or other impacts during transportation by third-party carriers; repairs or modifications made by anyone other than MOD LUXE; misuse, neglect, or improper storage; and exposure to water, fire, or other force majeure events.
This warranty is applicable only for the specified period and is subject to stated conditions. However, this warranty does not affect your legal rights as a consumer. MOD LUXE's liability under this warranty is limited to the actual purchase price paid by the customer. The warranty is non-transferable and cannot be assigned without prior notification to MOD LUXE, especially if the product is intended as a gift.
To initiate a warranty claim or request repair, please contact our Customer Service team at support@mod.luxe. Note that transport or delivery costs associated with a warranty claim are the responsibility of the customer. MOD LUXE reserves the right to choose between repairing, replacing, or refunding the product to fulfil the warranty.
3.1 Warranty Activation from Authorised Retailers
The warranty for products purchased through authorised retailers can be activated by contacting MOD LUXE at support@mod.luxe.
To initiate the warranty, the customer must provide proof of purchase, such as a valid sales receipt or invoice. Please include product details (e.g., model name or number) to ensure accurate warranty activation, along with your full name and email for record-keeping and communication purposes. MOD LUXE reserves the right to request additional documentation necessary for warranty validation.
Upon successful verification, you will receive confirmation of your warranty activation.
4. Sale and Pricing
A sale is confirmed upon completion of the ordering process and payment. Unless otherwise stated, prices displayed on the Site include GST (Goods and Services Tax) for orders within Australia and exclude GST for international orders. Shipping charges and any applicable sales taxes for international orders are specified separately during checkout.
6. Payment and Ordering Process
6.1 Payment Methods:
Payments are accepted through secure online platforms, including Shopify Payments and PayPal.
You agree to cover all associated costs, including any applicable duties, taxes, shipping, and handling fees.
6.2 Responsibility for Payment:
You are solely responsible for ensuring successful payment for your purchased product.
If payment cannot be validated or processed, your order will not be delivered, and MOD LUXE is not obligated to fulfil the order.
MOD LUXE is not liable for any payment issues arising from the operation of secure online payment systems.
6.3 Alternative Purchase Methods:
If you prefer to make a purchase by phone or email, please contact our Customer Service team at support@mod.luxe.
6.4 Ordering Process:
Select your desired product and add it to your virtual shopping cart. Proceed to the checkout page, where you will be asked to provide the necessary information for processing your order.
Choose your delivery preferences and review the product's price, along with any applicable shipping charges. To complete your order, click the "Pay Now" button, which indicates your acceptance of our terms and conditions.
6.5 Customs, Taxes, Duties, and Fees
MOD LUXE is not responsible for any import duties, taxes, customs fees, brokerage fees, or other charges imposed by your local government. These charges are solely the responsibility of the recipient and are collected directly by your local authorities.
As duties and taxes vary by country and region, we are unable to provide an estimated cost. For precise information, please contact your local customs office.
Please note that shipping fees and any taxes are non-refundable for packages refused or returned due to unpaid VAT/duties.
6.6 Order Accuracy and Billing:
Please review all product descriptions, prices, and billing details carefully before completing your order.
If you notice any errors, promptly notify our Customer Service team at support@mod.luxe to make corrections.
Once your order is complete, you will receive a confirmation email containing your digital receipt.
6.7 Correction Period:
You have thirty (30) days from the date of receiving your invoice to request corrections if any errors are identified and verified. After this period, the information on your invoice will be considered final and accurate.
6.8 Customer Declarations:
By completing an order, you confirm that you are of legal age and acknowledge that individuals under sixteen (16) are prohibited from making purchases on this site.
All purchases are intended for personal use only and are not for resale or commercial distribution.
You agree to provide accurate personal information for billing and confirm that you are the authorised holder of the credit card or PayPal account used for the purchase.
6.9 Order Confirmation:
A confirmation email will be sent shortly after your order is placed.
If you do not see it in your inbox, please check your junk or spam folder.
6.10 Acceptance of Orders and Cancellation Period
Receiving an order confirmation email does not guarantee acceptance of your order by MOD LUXE.
MOD LUXE reserves the right to cancel or refuse orders for reasons such as product unavailability, pricing errors, payment issues, or delivery restrictions. Additional verification or information may be requested before accepting the order.
If an order is canceled by the customer after 24 hours, a fee of up to 20% of the sales price may apply. Orders placed through our Personalisation Service cannot be canceled (see Section 7.4).
7. Personalisation Service and Special Orders
Our Personalisation Service allows you to create unique, handcrafted products tailored to your vision. Any product featuring customised elements not available for direct purchase on the Site is considered a personalised item. Personalised product customisations may include text engraving, logo placement, custom finishes, and other bespoke features.
You can add custom laser engraving to the SPLENDOUR Champagne Sabre directly through our website. Personalised options, such as text engraving and font style selection, can be chosen during the ordering process.
For specific requirements, such as logo engraving, custom materials, or unique finishes, please contact our support team to explore further options.
7.1 Custom Text Engraving Guidelines
- Length: Up to 40 characters (including spaces). Character limits will be displayed on-screen during customisation.
- Supported Characters: English characters and a limited range of special characters.
- Font Style Choices: Options are displayed on-screen during customisation.
- Engraving Placement: Your custom message will be laser-engraved on the blade of the Champagne Sabre, positioned in one line.
- Accuracy: Customers are responsible for ensuring the accuracy of all spelling, punctuation, and special characters when placing an order for personalised engraving. MOD LUXE is not liable for any errors submitted by the customer.
7.2 Processing Times for Orders with Personalised Engraving
We aim to dispatch all personalised orders within one business day. During peak times, custom orders may require an additional 2-3 business days before shipping.
For custom orders with specialised requirements, such as unique materials or finishes, the production and shipment timeline may vary based on material availability and production volume. Please note that manufacturing times provided initially are estimates and may be adjusted during the production phase as needed.
7.3 Content Review
Each customisation request is manually reviewed. MOD LUXE reserves the right to reject engraving requests containing content such as:
- Trademarked, copyrighted, or intellectual property without proof of ownership (please contact Customer Service before ordering).
- Profanity or inappropriate slang.
- Insulting, discriminatory, or offensive content.
If your submitted text is rejected, our Customer Service team will contact you to revise the content or issue a refund for the engraving fee.
7.4 Return Policy
Personalised items are non-returnable, non-exchangeable, and non-refundable.
8. Delivery and Damages
Products are dispatched based on the shipping option selected during order placement, as specified in your invoice.
MOD LUXE holds no liability for delays or clerical errors in the delivery address provided by you, or for delays resulting from force majeure events.
Additionally, MOD LUXE is not responsible for delays or damages caused by the logistics company.
Any damage to delivered products must be reported within 72 hours of receipt. Please contact Customer Service promptly. After this period, the product will be considered received in perfect condition.
If you are returning a defective or damaged product to MOD LUXE and the original packaging is compromised, MOD LUXE reserves the right to refuse the return and retain the sale price.
9. Return Policy
In line with Australian Consumer Law, MOD LUXE offers a 14-day return policy for eligible items. This period begins upon receipt of your item, granting you 14 days to request a return.
9.1 Eligibility Criteria
To be eligible for a return, items must be in their original condition—unused, with all tags attached, and in the original packaging. A valid receipt or proof of purchase is also required.
9.2 Initiating a Return
To initiate a return, please contact us at support@mod.luxe. Once your return is approved, we will provide instructions on where and how to send the package. Items returned without prior approval will not be accepted.
9.3 Personalised Items
All personalised items, including those with custom engraving, materials, and finishes, are considered final sale and are not eligible for returns or exchanges.
9.4 Return Processing Fee
MOD LUXE reserves the right to charge a processing fee of up to 20% of the sales price (before taxes) for accepted returns.
9.5 Damages and Issues
Please inspect your order upon receipt. Report any defects, damages, or discrepancies to Customer Service within 72 hours for evaluation and resolution.
If you are returning a defective or damaged product to MOD LUXE and the original packaging is compromised, MOD LUXE reserves the right to refuse the return and retain the sale price.
9.6 Exchanges
The quickest way to receive your desired item is to return the original item and make a separate purchase for the new item once the return is accepted.
9.7 Refunds
Upon receiving and inspecting your return, we will notify you of the approval status for your refund. Approved refunds are processed automatically to your original payment method. Please note that your bank or credit card provider may require additional time to process the refund.
9.8 Return Shipping Costs
MOD LUXE covers return shipping costs for cases involving incorrect products or defects in materials or workmanship. In all other cases (e.g., change of mind or exchanges), you are responsible for the return shipping costs.
10. Return Instructions
If your return has been accepted, please refer to the following general instructions. A member of the MOD LUXE team will also reach out to you with personalised instructions tailored to your order and situation. Please follow the precise instructions provided.
10.1 Packaging
The returned product must be in its original condition—unused and complete with original packaging.
Please ensure the product is correctly placed in its original blister packaging and securely packaged to prevent damage during shipping. MOD LUXE is not responsible for return shipping costs or for items that are damaged or lost during the return process.
10.2 Shipment
To facilitate the return process and avoid customs complications, we recommend returning the product via the same shipping provider and location as the original shipment or using a reputable, trackable postage service. MOD LUXE is not liable for any lost returned items.
Once tracking information is available, please share it with MOD LUXE’s Customer Service team.
10.3 Shipment Information
All returns should be sent to our fulfillment location in Sydney. Detailed return instructions, including the delivery address, will be provided upon return approval by our Customer Service team.
11. Jurisdiction and Applicable Laws
These terms are governed by the laws of New South Wales, Australia, excluding the United Nations Convention on Contracts for the International Sale of Goods. Any disputes shall fall under the jurisdiction of the courts of New South Wales.
12. Modification
MOD LUXE reserves the right to update or change these Terms of Purchase without prior notice. The terms applicable to your order will be those in effect at the time of purchase, and they shall prevail over any conflicting provisions.
