1. Formation of Contract

The purchase of MOD LUXE products (“Products”) via www.mod.luxe (“Site”) constitutes a legally binding agreement between MOD LUXE Pty Ltd (“MOD LUXE”, “we”, “our”) and the purchaser (“Customer”, “you”).

A contract is formed once an order is completed and payment has been successfully processed.

2. Product Integrity & Description

Each MOD LUXE piece is crafted with precision and material integrity.

Product descriptions, imagery, and specifications are presented as accurately as possible. Minor variations may occur due to:

• Natural material characteristics
• Hand-finishing processes
• Screen display settings

Such variations do not constitute defects and are considered part of the uniqueness of each piece.

3. Limited Warranty

MOD LUXE offers a one (1) year limited warranty from the date of purchase for defects in materials or workmanship on products purchased directly from www.mod.luxe.

This warranty does not cover:

• Normal wear and tear
• Surface marks, scratches, or impact damage
• Misuse or improper storage
• Modifications by third parties
• Damage during third-party transport
• Force majeure events
  

The warranty is non-transferable.

MOD LUXE reserves the right to repair, replace, or refund the product at its discretion.

Transport costs associated with warranty claims are the responsibility of the customer unless otherwise required by law.

This warranty does not limit your rights under Australian Consumer Law.

3.1 Warranty Activation – Authorised Retailers

Products purchased through authorised retailers may be registered with MOD LUXE by providing:

• Proof of purchase
• Product details
• Customer contact information

Warranty validation is subject to review.

4. Pricing & Taxes

Prices are displayed in Australian Dollars (AUD).

• Australian orders include GST
• International orders exclude GST

For international deliveries, the recipient is responsible for any import duties, customs charges, VAT, or local taxes imposed by the destination country.

MOD LUXE is not responsible for customs fees or delays.

5. Payment

Payments are processed via secure platforms including Shopify Payments and PayPal.

Orders will not be fulfilled until payment has been successfully authorised.

MOD LUXE is not liable for payment processing errors originating from third-party providers.

6. Order Acceptance

Order confirmation does not constitute final acceptance.

MOD LUXE reserves the right to cancel or refuse orders due to:

• Product unavailability
• Pricing errors
• Payment verification issues
• Delivery restrictions

If a customer cancels an order more than 24 hours after placement, a fee of up to 20% may apply.

Personalised items cannot be cancelled once production has commenced.

7. Personalisation Service

Personalised pieces are created to order and are considered final sale.

Customisation options may include:

• Laser engraving (up to 40 characters including spaces)
• Font selection
• Logo engraving (subject to approval)

Customers are solely responsible for:

• Spelling accuracy
• Character selection
• Submitted content

MOD LUXE reserves the right to refuse engraving requests containing:

• Trademark infringement
• Offensive or discriminatory language
• Copyright violations

Personalised items are non-returnable and non-refundable.

8. Delivery

Delivery timelines are estimates and not guarantees.

MOD LUXE is not liable for:

• Courier delays
• Customs processing delays
• Incorrect address submission
• Force majeure events

Any damage must be reported within 72 hours of receipt.

9. Returns (Non-Personalised Items)

In accordance with Australian Consumer Law, eligible items may be returned within fourteen (14) days of receipt.

To qualify:

• Item must be unused
• In original packaging
• With proof of purchase

A processing fee of up to 20% may apply.

Personalised items are final sale.

10. Refunds

Approved refunds are issued to the original payment method.

Bank processing times may vary.

Shipping costs are non-refundable unless the return is due to defect or error by MOD LUXE.

11. Jurisdiction

These Terms are governed by the laws of New South Wales, Australia.

Any disputes are subject to the jurisdiction of NSW courts.

12. Amendments

MOD LUXE reserves the right to update these Terms at any time.

The applicable Terms are those in effect at the time of purchase.
